Design and submittal of private initiatives
PPPs are contractual relationships between the public and private sectors for the provision of infrastructure and / or services, with a specific legal and financial scheme that seeks to ensure the financing, construction, operation, and maintenance of the project throughout the contract’s term. PPPs are usually implemented in a context of long-term investments and services, and are financed through deferred payments over time by the public sector or by users, or a combination of both.
We advise private investors throughout the process of public-private partnerships, starting from the formulation of the initiative until the signing of the respective concession agreement with the grantor:
- Advisory services until the prioritization of the initiative by the government. This includes the preparation of information requirements, the initiative’s submittal, and support and monitoring in the process in which public entities of the corresponding sectors give a favorable opinion to this initiative.
- Counseling up until the declaration of interest in the project: this includes the development or adjustment of pre-investment studies, support during the process of viability declaration, support during the favorable opinion process from the Ministry of Economy and Finance (MEF, for its acronym in Spanish) and the sector’s regulator, as well as follow-up activities during the process of Proinversión’s declaration of interest.
- Counseling up until the execution of the concession agreement: this includes support in the tender process and in the signing of the contract.
