We bring an economic/financial viewpoint to our analysis of allegations made by the parties in an arbitration proceeding and we evaluate the economic rationale of the supporting evidence for the alleged breaches committed. We quantify the economic damages and the compensation to be sought by applying the economic and financial concepts that best fit each particular case. Additionally, we evaluate sanctions and penalties applied in administrative proceedings.
Since 2014, the Economic Consulting area has undertaken more than 40 studies in disputes and arbitrations in different sectors, includinfg infrastructure, telecommunications, energy, hydrocarbons, water and sanitation, mass consumption, industry, fishing, among others.
The cases in which the Economic Consulting team has participated have involved disputes of different kinds, including breach of contract, tax disputes, differences in the interpretation of determining factors used in customs duty methodologies, etc
In our studies, we have estimated compensations owed due to loss of profit and consequential damages, as well as the likelihood of application when breaches result in opportunity loss. These studies use official financial models to estimate expected returns on capital and simulate cash flows under different scenarios.
